There are many legal tools and mechanisms available to help keep you safe, but they are NOT AUTOMATIC. You must be able to advocate for yourself in many circumstances to take full advantage of these legal tools.
Emergency Protective Orders
SFPD officers can issue EPOs at the scene of a crime and they must be approved by a judge. EPOs are good for Five (5) business days or Seven (7) calendar days. EPOs are not renewable.
Criminal Stay Away Orders
Issued when there is a criminal court case against your attacker, arranged through the District Attorney’s office and issued by the judge assigned to your case. They remain in effect for as long as the attacker is involved in the criminal justice system or until lifted by the judge. A Criminal Stay Away Order can also be made a condition of probation
Restraining Orders Issued By The Superior Court of California
Civil Harassment Restraining Order: Domestic Violence Restraining Order: Elder or Dependent Adult Abuse Restraining Order: Gun Violence Restraining Order: Workplace Violence Restraining Order.
